Introduction

In February 2022, the Commission adopted a proposal for a Corporate Sustainability Due Diligence Directive. Amongst other responsibilities, the proposal includes a new due diligence duty to be integrated into corporate policies. This would require companies to identify, prevent, mitigate, minimise and end adverse human rights and environmental impacts in their own operations, in their subsidiaries, and in their established direct or indirect business relationships in their value chain, both upstream and downstream.

The new due diligence duty proposal has a large scope of application. It would not only cover large EU companies, but also those operating in so-called high impact sectors as well as non-EU companies that meet the same criteria in respect of their net turnover generated in the EU.

The proposal also has wide-ranging consequences as victims of breaches would be able to bring a civil liability claim for damages before the national courts.
