The UK’s New Online Safety Regime - What it Means for You

Introduction

The EU has established a comprehensive set of new standards for online intermediaries and digital platforms in its Digital Service Act to tackle illegal and harmful content and to defend freedom of speech.

It is expected, alongside the Digital Markets Act, to have a transformative effect on the policing of online world in the EU.

Post-Brexit the UK is forging its own regulatory system for digital platforms having significant market status through the Digital Markets Unit within the CMA. Legislation is awaited to put the DMU and its powers on a statutory basis.

However, of wider impact and crucial importance in the UK is the establishment of a new regulatory framework for in scope online intermediaries and digital platforms to remove illegal and harmful content, control misinformation and disinformation and protect freedom of speech online.

Backed by substantial powers including the ability to fine companies up to 10% of their worldwide turnover or block or suspend their service, the new online safety regulator, OFCOM, is charged with enforcing the new regime.
