Deportation of EU Nationals - The Latest Position

Introduction

Although the United Kingdom has formally left the EU, that does not mean that a person’s status as an EU national has no bearing on the UK’s ability to deport them.

The Citizens’ Rights (Restrictions of Rights of Entry and Residence) (EU Exit) Regulations 2020 extended the protections of the Citizen’s Directive and the EEA Regulations 2016 to those who had committed offences before the December 2020 deadline, but with some restrictions. EU nationals are potentially at a heightened risk of scrutiny, given the close links that will remain between the security networks of the respective countries.

Now, more than 2 years after the severing of ties with the EU, the courts are beginning to grapple with what that means in practice.

This webinar will provide an overview of the changes, how that has been interpreted by the courts, and where the extra risks for EU nationals come from. The session will highlight the steps needed to prepare our clients for the possibility of deportation and provide tips on how to challenge decisions to deport when they arise.
