Course Outline
Introduction
This new virtual classroom seminar will take a deep dive into the often-thorny issue of equitable accounting.
It will consider common issues such as credits for repairs and improvements, mortgage contributions, accounts for rental income and the principles relating to equity of exoneration claims.
In addition, it will cover claims for an occupation rent by parties with a right to occupy the trust property and in other contexts such as claims by trustees in bankruptcy.
Consideration will be given to the statutory framework in the Trusts of Land and Appointment of Trustees Act 1996 and recent decisions such as Davis (as Trustee in Bankruptcy of Jackson) v Jackson and Another and Rowland v Blades.

- The principles governing the exercise of the court’s discretion in claims for an equitable account
- The differing considerations that apply where a claim is made for an occupation rent by a party with a right to occupation and in other contexts such as claims by trustees in bankruptcy
