Introduction

Forced marriage is an issue that affects many adults and children. The impact upon victims is significant, and it can cause a range of psychological and emotional difficulties which can be lifelong. This is an area where there have been recent changes to the law.

Whilst the scale of forced marriage is difficult to assess, awareness has grown. Practitioners in the field of child protection or vulnerable adults need to have knowledge of the development of forced marriage and the legal solutions now available.

This virtual classroom seminar will provide an introduction to forced marriage, focusing on the development of the law in this area, and the remedies available.

This live and interactive session will cover the following:

  • An outline of the scale of the problem and who is affected
  • The legal framework: civil and criminal
  • What a Forced Marriage Protection Order is, when the Court can make such an Order and the types of Orders that are made
  • Relevant guidance from the Court of Appeal in the case of Re K (Forced Marriage: Passport Order) [2020]
  • The interplay between forced marriage and care proceedings
  • Analysis of case law in relation to the inherent jurisdiction and wardship
