Course Outline
Introduction
This virtual classroom seminar is a must if you need an overview or a refresher course on the Public Contracts Regulations 2015 (PCR), the Concession Contracts Regulations 2016 (CCR), recent changes and an overview of the Procurement Bill.
Focussing on the practical application of the current and proposed regime, Léonie will cover the proposed simplification of public procurement, key recent developments and tips on achieving successful procurements.
The seminar is for lawyers, procurement officers and others in the public, private and charitable sectors with some knowledge of the public procurement regime.
What You Will Learn
This live and interactive session will cover the following:
- A summary of the PCR, CCR, proposed simplification of the regime in the Bill and a comparison with the PCR and CCR
- The regulations’ European Principles and post Brexit changes
- Definitions of 'contracting authorities', 'economic operators', what the PCR and CCR apply to and what is not regulated e.g. land transactions and certain inter-authority agreements
- Different procurement options (open, restricted, competitive dialogue with or without negotiation, dynamic purchasing systems, electronic auctions, framework agreements) their characteristics and choosing the best appropriate route
- Teckal companies, their definition and practical use
- The procurement process from preliminary market consultation, OJEU notices and any, post notice modification and conduct of the procurement
- Evaluation and award stages and challenge - their key characteristics and avoiding pitfalls
- Other changes under the PCR, publication on contract finder, sub-contracting and more
- Recent Cabinet Office and other government guidance
- The 'light touch' rules applying to social and other specific services including social enterprises
- Recent case law
- Practical tips and advice on how to achieve successful projects
